Terms of Service

These Terms govern your use of Brindl (the "Service"), a marketplace that connects buyers with independent sellers offering services and handmade or curated goods. By creating an account or using Brindl, you agree to these Terms. If you don't agree, please don't use the Service.

1. Accounts

You must be at least 18 years old to create an account. You're responsible for the accuracy of the information you provide and for keeping your password secure. You're responsible for anything that happens under your account, so let us know right away if you think someone else has access to it.

2. Listings & sellers

Sellers set their own prices, descriptions, and refund policies (including marking a listing "all sales final"). Brindl doesn't create, inspect, or guarantee any listing - sellers are solely responsible for the accuracy of what they list and for actually delivering the service or good once it's purchased.

3. Buying & payments

Payments are processed through Stripe. Brindl never sees or stores your full card number - Stripe handles checkout on its own secure page, and Brindl is only told whether a payment succeeded. All prices are in USD.

4. Fees & payouts

Brindl takes a platform fee (currently 10% plus a small fixed amount per sale) out of each sale; the rest goes to the seller. Sellers connect a bank account through Stripe to receive payouts, which are released 3 days after a sale to leave room for a possible refund. Fees may change in the future - we'll post the current rate on the How it works page rather than burying changes here.

5. Refunds

Refunds are handled directly by the seller from their own dashboard, according to the refund policy shown on the listing at the time of purchase. Brindl doesn't independently adjudicate refund disputes between buyers and sellers.

6. Acceptable use

Don't use Brindl to list anything illegal, to defraud another user, to post fake reviews, to circumvent platform fees by taking a transaction off-platform, to harass or impersonate anyone, or to upload content you don't have the rights to. We can remove listings, suspend accounts, or take other action for violations of these Terms.

7. Your content

You keep ownership of whatever you post - listing text and photos, reviews, messages, your profile. By posting it, you're giving Brindl permission to display it as part of running the Service. You're responsible for making sure you actually have the rights to anything you upload.

8. Copyright & DMCA

Brindl respects intellectual property rights and expects users to do the same. If you believe something on Brindl infringes your copyright, see our Copyright / DMCA Policy for how to submit a notice. We remove infringing content when properly notified and terminate accounts of repeat infringers.

9. Account termination

You can delete your own account at any time from Account settings, which removes your listings, reviews, and messages. We can suspend or terminate accounts that violate these Terms, including repeat copyright infringement.

10. Disclaimers & limitation of liability

Brindl is provided "as is," without guarantees that it will be uninterrupted or error-free. Brindl isn't a party to the transaction between a buyer and seller and isn't liable for the quality, safety, or legality of what's listed, or for disputes between users. To the fullest extent permitted by law, Brindl isn't liable for indirect, incidental, or consequential damages arising from your use of the Service.

11. Governing law & dispute resolution

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules.

Informal resolution first. Before filing any claim, you agree to contact us through the Support page and give us 30 days to try to resolve the issue informally.

Binding arbitration. If we can't resolve a dispute informally, you and Brindl agree that any claim arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration rather than in court, under the rules of the American Arbitration Association. This applies to claims already pending as of the date you're bound by these Terms, unless prohibited by law. Arbitration will be conducted in Indiana or another mutually agreed location, or by phone/video/written submission at your election for claims under $10,000.

No class actions. You and Brindl each agree to bring claims only in your individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative action.

Exceptions. Either party may bring an individual claim in small claims court instead of arbitration if it qualifies. Either party may also seek injunctive relief in court to protect its intellectual property rights.

Opting out. You can opt out of this arbitration agreement by emailing us through the Support page within 30 days of first agreeing to these Terms, stating clearly that you want to opt out. If you opt out, this arbitration section won't apply to you, but every other part of these Terms still will.

12. Changes to these Terms

We may update these Terms from time to time. Continuing to use Brindl after a change means you accept the updated Terms.
